This is a periodic update from The Point Owners Association, Inc. (POA) Board of Directors of matters that may be of general interest to the community. Streetlights – The POA Board approved a new service agreement this month with Duke Energy for the replacement of our streetlights.  The current specialty poles and fixtures originally specified by Crescent for our community were not a standard Duke Energy offering. The service in maintaining the 267 streetlights has not measured up to our expectations over the past years, mainly due to the replacement lead-times being up to six (6) months.  Coupled with this, the mercury vapor bulb (Blueish color) is no longer available and is being replaced with a high-pressure sodium bulb (Amber color) creating a mixed lighting arrangement throughout the community. The new fixture is a Deluxe Acorn LED mounted on a decorative pole.  This combination is going to be an outstanding upgrade to our decorative streetlight arrangement for the community.  A new LED fixture is mounted on an existing pole located at the private drive entrance of 1709/1717 Brawley School Road (BSR) for your viewing as you drive down BSR.  The goal is to have the replacements completed by the end of the year. However, the installation schedule may be impacted due to Duke Energy’s focus on the communities impacted by the Hurricane Florence.

NC law regarding tree removal – Hurricanes, tornadoes and ordinary thunderstorms can all tear up trees. But no matter why a tree falls, there’s almost always a question about who’s responsible for cleanup.  Regular homeowner’s insurance covers damage to your home from fallen trees.  Insurance pays to remove only trees that hit your house or garage or block a driveway or wheelchair ramp. When trees fall in your yard, you have to foot the bill to remove them.

Who pays is more complicated for trees on a neighbor’s property that fall on your property.  If a healthy tree falls during a storm, whoever has damage or the tree in their yard pays for it. That means that if your neighbor’s tree falls on your house, you and your insurance company pay for the damage. If your tree falls on your neighbor’s property, the neighbor pays for the damage.  However, if that tree was clearly dead or dying, the owner of the tree is responsible for the damage. Pay attention to trees in your yard and on your neighbors’ property. If one in your yard threatens a neighbor’s property, take the tree down.  If a neighbor’s tree threatens your home, let them know. If they don’t respond, send a certified letter to them, and take pictures of the tree. Then, if it falls and does damage, you have proof that your neighbor knew about it.  Vehicles hit by trees and falling debris are covered by auto insurance with comprehensive coverage.

Reporting fallen trees – If you see a fallen tree in one of our common areas, please contact Hawthorne Management at: [email protected] or 704-377-0114.  If a tree falls on one of our neighborhood streets where it is a safety issue, please contact the Sheriff’s Office at: 704-878-3180.

Lake Norman Volunteer Fire Department – As you may have noticed or read about on social media, our Lake Norman Volunteer Fire Department was highly responsive to the calls they received from our community about the trees that fell during Hurricane Florence.  If you live in one of the villages that they responded to, please consider donating to the fire department as a thank you.

Security Reminder.  Please keep in mind that criminals look for easy targets and other potential advantages particularly on holiday weeks and times when many neighbors travel. Please lock your doors, do not leave valuables in your vehicle, park vehicles inside the garage or keep them locked, and shut your garage door.  If you have a home security system, turn it on at night along with outdoor lights.  Also, secure loose items on any boats or docks. Please report suspicious behavior to the Sheriff’s Office.  They are there to help us.

Reporting A Crime to The Sheriff’s Office. If you need to report a crime or any suspicious activity to the Iredell County Sheriff’s office, call (704) 878-3100.  This is the direct line to the Sheriff’s office, and it is the best number to call to get the quickest response.  For non-emergencies, please call 704-878-3180.
